IV.3.2 The Peerage Heraldry Act of 7574 (XLIX ACG 2)

WHEREAS the inheritance of peerages in His August Majestie’s Kingdoms of Gondor and Arnor is, under the terms of the Peerage Continuity and Officers’ Incapacity Act of 7533, determined by designation of the incumbent peer, rather than by ordinary patterns of familial inheritance; and

WHEREAS it is therefore appropriate that there be separate heraldic insignia for peerages and for the persons holding them; and

WHEREAS those peers holding holding Palatine Authority under the New Administrative Areas Act of 7528 have heretofore marshalled by impalement with their own arms arms representative of that Authority consisting of the Royal Arms for Gondor, viz., Sable, the White Tree, and a chief distinctive of their peerage, e.g. for Anorien, Or a sun gules, as is more clearly depicted in the margin hereof.

NOW THEREFORE BE IT ENACTED by the Peers of the Realms and other Representatives of the true and faithful subjects of HIS AUGUST MAJESTIE THE KING of Gondor and Arnor in Council-General Assembled, to be a Statute among them, honoured as the King’s Own Word would be honoured, until they themselves unmake the law, or the King Return, or the World End, THAT

Article One. Definitions. For the purposes of this Act:

  1. “Inseparable peerages” are peerage titles subject to the restriction of Article Three, Section Four of the Peerage Continuity and Officers’ Incapacity Act of 7533, prohibiting a peer from devising titles on more than one heir without the prior consent of the Council-General.

  2. “Separable peerages” are peerage titles not subject to the restriction of Article Three, Section Four of the Peerage Continuity and Officers’ Incapacity Act of 7533, prohibiting a peer from devising titles on more than one heir without the prior consent of the Council-General.

  3. “Peerages of a single creation” are peerage titles granted to a single individual by the same Letters Patent, Writ of Summons, or other Act of Creation, and all such peerages are inseparable unless otherwise provided in the Act of Creation. Appendix One contains a list of the currently existing peerages of a single creation.

  4. “Conjoined peerages” are peerage titles, or sets of peerages of a single creation, held by a single individual in respect of two or more separate Acts of Creation in favor of that person. Such peerage titles, or sets of peerages of a single creation, are separable peerages unless otherwise provided in the Act of Creation, provided, that within the period of a year and a day from and after the passage of this Act, any current holder of conjoined peerages may notify the Lord Great Steward of the holder’s desire that the peerages henceforward be inseparable, and the provisions of Article Three, Section Four of the Peerage Continuity and Officers’ Incapacity Act of 7533 shall thereafter apply. Appendix Two contains a list of the currently existing conjoined peerages.

  5. “Coincident peerages” are peerage titles, or sets of peerages of a single creation, held by a single individual as a result of the individual having been separately designated heir to them. Such peerage titles, or sets of peerages of a single creation, are separable peerages. There are currently no coincident peerages.

Article Two. Heraldic Insignia for Peerages. Section One.

a) Every single peerage, or set of peerages of a single creation which are inseparable, shall have a single coat of arms.

b) Conjoined peerages which are inseparable shall have a single coat of arms.

c) Coincident peerages, and conjoined peerages which are separable, shall have distinct coats of arms.

Section Two.

a) A peer holding an inseparable peerage may marshal the arms of the peerage together with the peer’s own arms by impalement, with the arms of the peerage to the dexter and the peer’s own arms to the sinister.

b) A peer holding separable peerages may marshal the arms of the peerages together with the peer’s own arms by impalement, with the quartered arms of the peerages to the dexter and the peer’s own arms to the sinister.

c) Peers holding Palatine Authority in respect of a peerage or peerages may marshal the arms of the peerage or peerages as a chief above the Royal Arms for Gondor, impaling the whole coat to the dexter and the peer’s own arms to the sinister, as has been done heretofore, and as is represented more clearly with the arms of the Palatine Duchy of Númenor and Houghton in the margin hereof.

Article Two. Transition Period; Authorization for the Design and Granting of Arms. Section One. During the period of a year and a day from and after the passage of this Act, the current holder of any peerage, having not already used separate arms for the peerage and for the peer’s own family, may notify the Lord Great Steward and the Anor Principal King of Arms, or such other competent authority as the Lord Great Steward may designate, that the arms the peer currently uses are to be taken as the arms of the peerage; and in default of such notice, any arms in use by a peer shall be taken to be the arms of the peer’s family and not of the peerage.

Section Two. The Anor Principal King of Arms, or such other competent authority as the Lord Great Steward may designate, may, without need for further warrant, devise and grant arms and other heraldic insignia for peerages as required by this act, consulting, where possible, with the current holder of the peerage, but not being bound by the current holder’s advice; provided, that the authority issuing an Act of Creation may therein specify arms and other heraldic devices for the new peerage or peerages, and that nothing in this Act shall limit His August Majestie’s sovereign authority as the font of honor, as exercised in their respective jurisdictions by the Regent and Lord Great Steward, to issue new arms or augmentations to existing arms.

Article Three. Implementation. Section One. This Act shall have full force and effect from and after the time of its passage by the Council-General.

Section Two. This Act may be cited as The Peerage Heraldry Act of 7574 and shall constitute Chapter V.4 of the Composite Code of the Kingdoms of Gondor and Arnor.
